Register your trademark with ease

The mark you’re interested in adopting could be in use by a third party or already registered at the USPTO. Conducting the proper research in the early stages of building a business is crucial! While no trademark search is 100% effective in predicting success in registration, I can reduce the potential for infringement claims as much as possible.

I charge a flat fee to perform trademark searches and file U.S. trademark applications. Pricing is based on a per-class basis, meaning your pricing will be specific to the good and/or service you offer.

Trademark searches

A “knock-out” or preliminary trademark search is the first search that should be performed. This type of search, which looks for marks that would cause a likelihood of confusion in the marketplace, can provide feedback that is useful in deciding whether or not to conduct a full comprehensive U.S. search. The objective is to discover marks that would immediately present an obstacle to registration at the USPTO or place the mark owner at risk of being sued for infringement. This search is performed manually and is limited to applied-for (live) and registered trademarks with the USPTO. A typical knock-out or preliminary trademark search generally takes about an hour to two hours (per mark) to perform.

 

If there are no obvious conflicts, I might advise that a full U.S. comprehensive search from the firm’s preferred third-party provider per performed. This comprehensive search examines trademarks and trade names from a number of databases. We have found that obtaining a comprehensive search is particularly effective in identifying unexpected and complex potential conflicts. The full U.S. Comprehensive search takes approximately one week to receive the results report and, depending on the results of the report, my review and analysis can take several hours to complete.

The first step in applying for your proposed mark is determining whether to apply for the mark on a use basis (currently being used commercially across state lines) or on an intent to use basis (reserving a trademark for future use). While the search and application process is largely the same for both categories, the distinction will be important when filing the actual trademark application.

Next, we would determine the types of goods or services you are currently selling in connection with the mark and/or those for which you intend to use it. I would work with you to carefully and affordably craft your application to make sure that you register in the classes that offer the broadest protection.
